Telangana

The Telangana Minimum Wages CPI Notification (April 2022)

As per press note released, Commissioner of Labour Telangana, Hyderabad and the Competent authority under the Minimum Wages Act, 1948 has declared the CPI points for calculation of variable dearness allowance for the state of Telangana with effect from 1st April 2022

Central

The Employees State Insurance (Central) Amendment Rules, 2022

ESIC vide notification no.G.S.R. 176 (E ) has amended provision on sickness benefit under The Employees’ State Insurance (Central) Rules, 1950. As per amendment, insured women who are receiving maternity benefit can also claim sickness benefit i.e cash benefit in case shorter contribution period is available to her, provided that contribution shall be payable for not less than half the number of days available for working in such contribution period. Therefore, amendment entitle insured women to claim the sickness benefit and such retrospective amendment shall not prejudicially affect any beneficiary of any other benefit entitled under Employees’ State Insurance Act, 1948. Punjab

Exemption To Conditions For Women Employee Under The Punjab Shops And Commercial Establishment Act, 1958

The Governor of Punjab vide notification No. Labour-Lab0PSCA/2/2021-5L/I/325484/2022 and supersession of notification dated 15th October, 2014 is pleased to formulate a scheme for the Shops and Establishments in the state under The Punjab Shops And Commercial Establishment Act 1958. As per the scheme, exemption given to the provisions towards conditions of employment for women and exemption will be given on case to case basis on receipt of applications from the establishments on the mentioned terms and conditions. The exemption awarded towards working hour of women employee subject to conditions mentioned in the notification. Please refer to the notification which provide details on conditions

EPFO Circular On Trainees Under National Employability Enhancement Mission (NEEM)

EPFO vide circular No.Compliance/NEEMscheme/2021 recommended to all additional central provident fund commissioner and Zonal commissioners that provisions towards The Employees Provident Fund And Miscellaneous Provisions Act, 1952 will be applicable for the students getting placement in companies and appointed as employee of the establishments even during job or training or induction and other trainings taken after becoming employee. Therefore, Trainees Under National Employability Enhancement Mission are not exempted from the definition of "employee" under The Employees Provident Fund And Miscellaneous Provisions Act, 1952. Extension Of Shops And Establishments Enactment In Certain Local Areas Of Madhya Pradesh

Government of Madhya Pradesh vide notification No.291-52-2022-A-XVI has extended the application of The Madhya Pradesh Shops And Establishments Act, 1958 in the areas comprised within the local limits of nagar panchayats such as Bilhara, Malthon, Surkhi, Bandri of Sagar district in Madhya Pradesh. Haryana

Honourable Supreme Court Set Aside Order On The Haryana State Employment of Local Candidates Act, 2020

The Hon'ble Supreme Court of India set aside the stay order of the Punjab And Haryana High Court dated 03rd February 2022 which halted the implementation of the Haryana State Employment Of Local Candidates Act,2020 until such time that the constitutional validity of the legislation is determined. The Supreme court, while setting aside the stay, directed the Punjab and Haryana high court to expedite the hearing and decide on the validity of the law within a month. It is also observed that no coercive action shall be taken against companies that do not comply with the law that mandates seventy five percent reservation for the state’s residents in jobs paying less than thirty thousand a month.
