The Kerala Minimum Wages Notification (June 2021)
The Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No.DES/859/2021-P3(1), the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of June 2021 ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act
Maharashtra
The Maharashtra Minimum Wages VDA Notification (July 2021)
The government of Maharashtra has released revised minimum rates of wages (variable dearness allowance) effective from 1st July 2021 which will be valid till 31 December 2021
Manipur
Governor of Manipur has promulgated ordinance on The Manipur Shops And Establishments (Regulation Of Employment And Conditions Of Service) Ordinance, 2021. As per the ordinance, (i) It shall apply to all shops and establishments employing ten or more workers (ii) It repeals The Manipur Shops And Establishments Act,1972. Madhya Pradesh
The Amendments Under The Madhya Pradesh Child Labour (Prohibition And Regulation) Rules,1993
Government of Madhya Pradesh vide notification no.1036-183-2018-A-XVI has amended The Madhya Pradesh Child Labour (Prohibition And Regulation) Rules,1993. As per the amendment,(1) Inserted a new provision towards awareness on prohibition of employment of child and adolescents in contravention to Act, child to held his family without affecting education, child to work as an artist, hours of work for an adolescent person, payment of amount to child or adolescents for labour rehabilitation fund, person who are capable of filing complaints, provision towards compounding an offence, duties of magistrate and inspector, periodical inspection and monitoring, (2) New provision also include liability of producer for involving a child in audio-visual production or any commercial event and producer for such activity shall furnish Form C to the district magistrate for approval, (3) Replaced the previous rule towards certificate of age and therefore, (i) mandated that employer shall produce a certificate of age received from the appropriate medical authority to the Inspector on demand, (ii) The appropriate medical authority while examining an adolescents shall consider details such as Aadhar card, the date of birth certificate, birth certificate of adolescents given by a corporations or a Municipal Authority or a Panchayat. The Government of Rajasthan vide notification No.F8(5)(6)Min. M/Labour/2000/Part/15340, has released minimum wages for the state of Rajasthan effective from 1st July 2020
Tamil Nadu
Enforcement Of Provisions Towards ESIC In Madurai Districts Of Tamil Nadu
ESIC vide notification S.O. 2983(E) has implemented the provisions towards Chapter IV (Contribution), Chapter V (Benefits), Chapter VI (Adjudication Of Disputes and Claims) effective from 1st day of August 2021 in all the areas of Madurai district in the State of Tamil Nadu. Karnataka
Amendment To Working Hours For Opening Of Shops And Establishments 24*7 In Karnataka
Government Of Karnataka vide notification No.E-LD 4 LET 2019 (p) has amended para 4 of the previous notification published on 2nd January 2021. As per the amendment, the working hours has now been amended to nine hours (instead of eight hours) on any day and forty-eight hours in any week with condition that the total number of hours of work including overtime shall not exceed ten hours in any day and the total number of overtime hours worked by an employee does not exceed fifty hours in a period of three continuous months. Goa
The Goa Factories (Fifteenth Amendment) Rules, 2021
The Government of Goa vide notification no. VI/FAC-6(L-1)Part-1/IFB-2020/975 has amended provision towards competent person, approval of plans, use of premises as a factory, certificate of stability, application for registration, renewal of license, mode of payment of fees, medical examination of workers, Latrine accommodations, pressure vessels or plant, medical examination, occupational health centre, qualifications of supervisors, dangerous manufacturing process and other schedules under The Goa Factories Rules, 1985. The brief of amendments mentioned below, (1) The fees towards application of competent person has been increased from ten thousand to twenty thousand, (2) Clause inserted towards approval by Chief Inspector for existing building/shed/structure/work of engineering construction, (3) The person issuing certificate of stability shall be a structural engineer instead of competent person, (4) The application for registration and license shall be accompanied with fees as replaced, (5) The renewal of license shall be made through online mode, within three months including fees shall be paid through e-challan payment gateway, (6)The mode of payment of fees shall be online through e-challan payment gateway under the said head of account, (7) The amendments also includes insertion of new rule towards arrangements of personal protective equipment. Tamil Nadu
Amendment Under Tamil Nadu Business Facilitation Rules, 2017
The Governor of Tamil Nadu vide notification G.O. (Ms) No.197 has notified amendments under Annexure 2 (List of Clearances and associated timelines for processing) of The Tamil Nadu Business Facilitation Rules, 2017. As per amendment, (i) The registration to be issued within seven days for employing contractual workmen under The Tamil Nadu Shops And Establishments Rules, 1948 (CLRA) and filing can be processed with Labour Department (ii) The registration to be issued within seven days for employing inter-state migrant workmen under The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) (Tamil Nadu) Rules, 1983 (ISMW Act) (ii) The registration under CLRA, ISMW Act can be processed through Directorate of Industrial Safety and Health (DISH). The Amendments has not yet published in the official gazette of Tamil Nadu, hence till such publication, the effective date of these amendments will be in abeyance.
