The Maharashtra Shops And Establishments (Regulation Of Employment And Conditions Of Service) Act, 2017

The Maharashtra Government via gazette dated 7th September 2017 has published the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. Following are important highlight of the Act: (1) The Act will be applicable to establishment employing 10 or more persons. The application for registration under the Act can be made online. (2) There is only one head of definition i.e. "Establishment" which will cover Shops and residential hotels, restaurants, eating houses to theatre, other places of public amusement. Establishment of Legal Practitioners are removed from the definition of establishment. (4) Women can work between 9.30 p.m. and 7 a.m., subject to the provision of safety met by the employer as per the Act. (5) An establishment may be kept open for business on all days in a week but every worker shall be allowed weekly holiday of at least twenty-four consecutive hours of rest. Specific timing of opening and closing is not mentioned, which may be fixed by the State Government through official notification. (7) The spread-over of a worker in establishment shall not exceed ten and half hours in any day, reduced from existing eleven hours. (8) Interval of rest after five hours of work is half and hour, reduced from existing one hour. (9) Over-Time has been provided at one hundred twenty five hours in a quarter, increased from six hours a week. (10) Earned/Privileged Leave Increased to forty-five days from forty-two days. Worker can encash leave in excess of forty-five days, if the employer refuses to sanction the leave. Irrespective of period of employment, the employees are entitled to eight festival holidays a year. (12) Welfare measures such as Canteen, Drinking water, Creche facility have been introduced. Canteen facilities shall be provided for establishment employing more than hundred employees. Drinking Water Facilities should be provided at suitable points. Creche facility has to be provided within a radius of one kilometre where there are more than fifty employees employed The existing Maharashtra Shops Act, 1948 will be repealed once the new Act comes into force. The effective date of the Act shall be notified by the Government on a later date by publication in the official gazette. The Rules pursuant to the Act are yet to published

Refund Of EPF/EPS Accumulations To Japanese Expatriate Workers As Per SSA With Effect 1st October 2016

As per EPFO circular dated 1st September, the EPFO has cited that the India Japan SSA has become effective from 1st October 2016. As a result EPF/EPS contributions are not required to be deposited for Japanese expatriate coming to work in establishment covered under EPF & MP Act 1952. All Japanese expatriate workers working in India and the Japanese workers who left India before 1st October 2016 should receive a refund of their EPF/EPS contributions

Wage Ceiling Under The Payment Of Wages Act Increased From 18,000 To 24,000

As per notification number S.O. 2806 (E) published on 29th August 2017, the Ministry of Labour and Employment has notified that in exercise of the powers conferred by sub-section (6) of section 1 of the Payment of Wages Act, 1936, the Central Government, on the basis of figures of the Consumer Expenditure Survey published by the National Sample Survey Organization, hereby specifies rupees twenty four thousand per month as the wages under said sub-section (6)

The Kerala Minimum Wages Notification (June 2017)

Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No. P3.Pdl.1/2017/DES, the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of June 2017 are as ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act

Revised Composite Claim Form for Death Case Replacing Form 20, 10-D And Form 5-IF

As per EPFO circular dated 21st August 2017, the EPFO with a view to simplify the submission of claim forms by the subscribers has released a new revised Composite Claim Form for Death Case to replace erstwhile Form No. 20, Form 10-D and Form 5-IF. Please refer to the revised Composite Claim Form in the notification

Revised Form For Authorisation Of Housing Loans From PF Account

As per EPFO circular dated 18th August 2017 which was released in continuation to the previous circular dated 21st April 2017, the EPFO has revised the application form for Housing loan by PF members and has also directed the Cash Branch to ensure that generation and disbursal of EMIs in respect of the all claims under para 68-BD( 4) of EPF Scheme, 1952 should be made on the first working day of the month. The necessary letter of intimation shall be sent to the lending agency and the member on first working day of the month. Please refer to the revised application form in the notification

Himachal Pradesh

Employment Of Women In Haryana Factories During Night Shifts

As per recent notification dated 17th August 2017, the Haryana Government has cited Madras High Court Decision in view of which the government will allow to employ women workers in the factories during night shifts i.e. from 7 pm to 6 am. Any factory in the State, registered under The Factories Act, 1948 may apply for this exemption. Such exemption will be valid for one year from the date of its publication in the Official Gazette. Please refer the notification for conditions for grant of exemption

West Bengal

Single Annual Integrated Online Return Under Various Labour Laws

As per notification published in the Kolkatta Gazette dated 28th August 2017, the Government of West Bengal has cited that multiplicity and varied periodicity of submission of Returns under Labour Laws has been a cause of unease amongst the Factories / Shops or Establishments / business entities; and thus, the Government has introduced the online submission of Single Annual Integrated Return under the following Acts: (i) Contract Labour (Regulation & Abolition) Act, 1970; (ii) The Building and Other Construction Workers' (RE &CS) Act, 1996; (iii) Motor Transport Workers Act, 1961; (iv) Interstate Migrant Workmen (RE &CS) Act, 1979; (v) Minimum Wages Act, 1948; (vi) Factories Act, 1948. The Tamil Nadu Industrial Establishments (National And Festival Holidays) Amendment Act, 2017

As per Tamil Nadu Gazette dated 7th August 2017, the Government of Tamil Nadu has amended the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act, 1958. As per the amendment the Government can now declare any day, other than holidays mentioned in the Act, as a special holiday with regard to any emergency or special circumstances prevailing in the State or any part thereof. State Government shall by separate notification release the effective dates for this Act
