Transparent Inspection Scheme

The new Transparent Inspection Scheme provides for exemption of low risk Factories from Labour compliance inspections under all Labour Laws. New criteria for Inspection has been established and hazards have been divided into three levels. There will be a preparation of quarterly list of inspection of factories/establishments by a randomly generated computerized system. Inspecting officer shall give fifteen days notice prior to the date of inspection to the management along-with the checklist for the inspection (also available online). The inspection report shall be prepared and uploaded within forty eight hours from the date of completion of inspection. Employee Pension Scheme Changes For UAN Holders

As per Notification No. Pension 1/7(1)96/Forms/7869 Government has notified that employees whose details like AADHAR number and Bank Account number have been seeded in their UAN and whose UAN has been activated may submit claims in Form 10-D-UAN (Application for monthly Pension) directly to the commissioner without attestation of their employers

Employees Provident Fund And Miscellaneous Provisions Act, 1952

As per G.S.R.543 (E) released on 24th May 2016, EDLI benefit is now the average monthly wages drawn (subject to a maximum of fifteen thousand rupees), during the twelve months preceding the month in which the employee died, multiplied by thirty times plus fifty percent of the average balance in the account of the deceased in the Fund or of a provident fund exempted under section 17 of the Act or under paragraph 27 or 27 A of the Employees Provident Funds Scheme, 1952, as the case may be, during preceding twelve months or during the period of his membership, whichever is less, subject to a ceiling of one lakh and fifty thousand rupees, subject to a total ceiling of six lakh rupees

Andhra Pradesh

G.O. Ms. No. 26 Permitting all Shops and Establishments in Andhra Pradesh to keep open on all 365 days in a year initially for a period of five years

Retail enterprises can remain open 365 days a year for a period of 5 years, subject to conditions that: 1) Retail enterprise is a shop as per A.P. Shop Act 2) Employees are given compensatory and compulsory weekly holidays 3) Working hours should not be more than eight hours per day and forty eight hours in a week 4) Overtime register is maintained and OT is paid at twice the ordinary rate of wages 5) Employees working on a national, festival or other holiday shall be compensatory holiday and wages at twice of ordinary rate 6) Working hours from 6 AM to 11PM with minimum two shifts, with one hour gap for changeover period 7) Women can work in all shifts, provided that conveyance from office to residence is provided 8) Part-time allowed and rates as proportional to monthly minimum wage rate, retail unit cannot engage more than 25% of employees as part time employees 9) Wages to be only paid in bank account 10) All employees shall be furnished with an appointment letter, with one copy online to Inspector 11) EPF and ESI contribution by employer and employee to be remitted every month 12) Records like wage register and muster roll may be maintained in electronic form and be accessible to Inspector
