Exemption For Shops And Establishments From Renewal Of Registration In Andhra Pradesh
Government of Andhra Pradesh vide notification G.O.Ms.No.15 towards implementation of Ease Of Doing Business Scheme under the Andhra Pradesh Shops And Establishments Act, 1988 has exempted all shops and establishments registered under section 3 of the Act from renewal of registration under section 4 and section 3(3) of the Act read with rules 3(4), 3(5), 3(6) and 3(7) with effect from the date of publication

Central
EPFO Circular On Verification Of The Authenticity Of The Records Submitted By The Employer
EPFO vide letter no.pension-I/12/33/EPS Amendment/96/Vol.II/34007 dated 23/03/2017 has previously directed to all field offices to take necessary action in accordance with the order of Hon'ble Supreme Court in SLP No.3302-33033 of 2015 as approved by the Government and as per provision of EPF & MP Act, 1952 and scheme framed there under. In this regard, EPFO vide circular no.Pension/12/33/EPS-Amendment/96/vol.II/1946 dated 4th June 2019 has further written to all in charge of field offices to verify the documents submitted by the employer along with original records to ensure that no payments is based on forged/fabricated documents for revision of pension on higher wages from 16/11/1995 or the date on which salary exceeded the ceiling limit showing the details of higher wage on which PF contribution was remitted. EPFO has further directed the field offices to ensure the authenticity of the documents submitted by the employer and also the eligibility of the concerned member before revising pension on higher wages. Note: These directions are in respect to the earlier Apex court decision dated 4th October 2016 on higher pension under EPS, 1995 and not recent Judgement (SLP D.9610/19) of the Hon'ble SC on higher pension under EPS,1995 and not recent Judgement (SLP D 9610/19) of the Hon'ble SC on higher pension pertaining to Employees Pension (Amendment),scheme 2014 wherein the EPFO has filed a review petition under Apex Court

Tamil Nadu
Tamil Nadu Shops And Establishments Permitted To Remain Open 24x7 days For Three Years
Government of Tamil Nadu vide notification no G.O (Ms) No. 60 exempts all Shops And Establishments employing 10 or more persons from the provisions of sub-section 1 of Section 7 and sub-section (1) of Section 13 of the said Act and permits them to keep open the establishment 24x7 on all days of the year for a period of three year with effect from date of publication of this notification subject to conditions mentioned in the notifications, such as 1) Employee shall be given one day holiday in a week on rotation basis and details shall be provided in Form-S included in the Tamil Nadu Shops and Establishment Rules, 1948 and Form-S shall be exhibited in a conspicuous place in the establishment, 2) Employer shall exhibit details of the employees who are on holiday/leave on daily basis in a conspicuous place in the establishment, 3) Wages including overtime wage shall be credited to their savings bank account, 4) Employer shall not allow any person to work for more than eight hours on any day and forty eight hours in any week and period of work including overtime shall not exceed ten and half hours in any day and fifty seven hours in a week, 5) Employees working on any holiday without proper indent of overtime shall attract penal action against the employer/manager as provided in the said Act and rules, 6) Women employees shall not be required to work beyond 8.00 p.m. on any day in normal circumstance. Provided that the employer after obtaining written consent from a woman employee shall allow her to work between 8.00 pm and 6.00 am subject to protection of her dignity, honour and safety, 7) Transport facilities shall be provided to the employee who works in shift. A notice shall be exhibited at the main entrance of establishment indicating availability of transport, 8) Employees shall be facilitated with restroom, washroom, safety lockers and other basic amenities, 9) Employers employing woman employee shall constitute an Internal Complaints Committee against sexual harassment of women under the Sexual Harassment Of Women at Workplace ( Prevention, Prohibition and Redressal) Act 2013 and the said committee shall be operative. On violation of any statutory provision and above terms and conditions noticed by the inspector, penal action

Karnataka
Government of Karnataka vide notification bearing no LD 194 LET 2016 has further exempted IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge based Industries for a period of another five years from the applicability of Industrial Employment (Standing Order) Act, 1946. This in continuation to the earlier notification dated on 25th January 2014, vide notification no LD 53 LET 2013 released towards exempting IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge-based Industries for a period of five years from the applicability of Industrial Employment (Standing Order) Act, 1946. However the said exemption from the applicability of Industrial Employment (Standing Order) Act, 1946 are subject to the conditions as mentioned a) Each IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge-based Industries shall constitute Internal Committee as per Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013, b)Each IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge-based Industries shall constitute a grievance Redressal Committee (GRC) comprising of equal number of persons representing employer and employee to address complaint/grievances of any employee. The GRC shall be provided with all powers to handle all types of complaint/ grievances of employee within reasonable time, c) Each IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge-based Industries shall intimate information about the cases of disciplinary action like suspension, discharge, termination, demotion, dismissal of its employee to the Jurisdictional Deputy Labour Commissioner and Commissioner of Labour in Karnataka, d)Information regarding service condition of employees of IT/ITES/Startups/Animation/ Gaming/ Computer Graphics/ Telecom/BPO/KPO/other knowledge-based Industries, as required by the jurisdictional Deputy Labour Commissioner and Commissioner of Labour In Karnataka shall be promptly and fully submitted by every employer within the reasonable timeline fixed by the authority
