The Contract Labour (Regulation And Abolition) (Uttar Pradesh Amendment) Act, 2017
As per notification published in the Uttar Pradesh Official Gazette dated 29th January 2018, the Uttar Pradesh Government has amended the Contract Labour (Regulation and Abolition) Act 1970. The major changes which will only be applicable to Uttar Pradesh are as follows: (1) The applicability of the Act has been increased from 20 employees to 50 employees. (2) The registering officer has to revert within one day on registration application status, if officer fails to make any order then the registration is deemed granted. (3) The licensing officer has to revert within one day on contract labour license application status, if officer fails to make any order then the license is deemed granted. (4) Compounding of offences has been introduced

Return Of Ownership And Amendment Towards PF Registration Now Made Online
As per EPFO circular dated 25th January 2018, that every employer in relation to a factory or other establishment to which the Employees' Provident Funds & Miscellaneous Provisions Act, 1952 applies, shall furnish online/electronically in Form No. 5A, particulars of all branches and departments, owners, occupiers, Directors, Partners, Manager or any other person or persons who have the ultimate control over the affairs of such factory or establishment and also furnish details of changes in such particulars within 15 days of such change. E-sign facility has been provided to the employers for online submission of Form No. 5A. EPFO or PF Office have also stated that Offline/Physical submission of Form No. 5A stands discontinued. Details for online submission of Form No. 5A are available on the website of the EPFO (Employees' Provident Fund Organization). EPFO or PF Field offices have also been directed to not ask hard copies in case of submission of form 5A with digital/e-signatures by employers

The Kerala Minimum Wages Notification (Oct 2018)
Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No. P3.Pdl.1/2018/DES, the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of October 2018 are as ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act

The Minimum Wages (Uttar Pradesh Amendment) Act, 2017
As per notification published in the official gazette dated 12th January 2018, the Uttar Pradesh government has amended the Minimum Wages Act, 1948 to make a significant change to Section 11 - Wage Payments, wherein the Payments have to be compulsorily made through cheque or NEFT (National Electronic Fund Transfer), ECS (Electronic Clearing Service System) or other banking solutions. Cash payments are allowed only if the work of the employed person is temporary, casual or fixed term then on his written consent and and on a submission of a copy of his self attested aadhar card, the employer can make cash payment of wages for not more than five thousand once in three months for such employee

As per notification dated 11th January 2018, Tamil Nadu Government under Section 3(2) of The Tamil Nadu Industrial Establishments (National, Festival And Special Holidays) Act, 1958, has declared a holiday tomorrow i.e 12th January 2018 in Chennai, Thiruvallur and Kanchipuram district. This is to allow workers from other parts of Tamil Nadu to go to their home town to celebrate Pongal festival

Abolishing Of Uploading Copy Of Pan Card At The Time Of Registration Of Establishment
As per EPFO circular dated 8th January 2018, the EPFO has informed that the requirement of uploading the scanned copy of PAN card at the time of registration of establishment has been examined and online system has been put in place for verifying details of PAN directly from the Income Tax Department. Hence, it has been decided by the competent authority that there is no need to upload the scanned copy of PAN card at the time of registration of establishments. Information Services Division has already carried out necessary modifications in the software accordingly
Goa
The Goa Factories (Fourteenth Amendment) Rules, 2017
As per notification published in the Goa Official Gazette dated 4th January 2018, the Government of Goa has changed the fees for license, renewal of license and has extended the period of license renewal from five years to ten years. In case of a factory coming within the scope of the Act, where the application for registration and grant of license is made after the commencement of the manufacturing process, the occupier and manager, from the date of commencement of the manufacturing process till the date of submission of application for registration and grant of license, shall be liable to pay additional fee at the rate of two hundred percent of the fees payable per year. In case of closure of factory, along with notice of closure information sent shall be accompanied by a treasury receipt or an invoice for book adjustment, as the case may be, for payment of the fees due to be paid, if any, till the date of closure and a declaration stating that there is no presence of hazardous chemicals in the premises of the closed factory or the said hazardous chemicals have been shifted/disposed off in accordance with the relevant rules in force

Uttar Pradesh Government has released notification dated 4 January 2018, confirming the VDA for the period from 01-04-2017 to 30-09-2017 will hold good for the period from 01-10-2017 to 31-03-2018.

Employer Contribution To EPF Need Not Mandatorily Exceed Statutory Wage Ceiling Limit
As per EPFO circular dated 3rd January 2018, EPFO has reiterated (the Supreme Court Judgment in the matter of Marathawada Gramin Bank Karamchari Sangathan and another Vs. Management of Marathawada Gramin Bank) and has directed that employers cannot be forced to contribute over and above the statutory wage ceiling in respect of their employees. However, option is available for the employees to contribute beyond the statutory wage ceiling if they so desire subject to the conditions enumerated under Para 26 (6) of the Employees' Provident Funds Scheme, 1952
