Establishments Brought Under The Purview Of The Puducherry Shops And Establishments Act

As per Government of Puducherry GO dated 27th October 2017, the Government has declared the following as "establishments" for the purpose of implementation of various provisions of Labour Laws, viz. (1) Distribution of Liquefied Petroleum Gas Cylinders, Petrol and Diesel; (2) All Private Hospitals & Medical Colleges; (3) Insurance Companies; (4) Pharmaceuticals; (5) Clinical Laboratories; (6) Chamber of Commerce; (7) All Private Banking organizations and Financial Institutions; (8) Quasi Government Organizations like Puducherry Argo Service and Industries Corporation Ltd., Puducherry Argo Products, Food & Civil Supplies Corporation Ltd., Amudasurabi and other Co-operative Institutions; (9) Clubs; (10) All Private Educational Institutions; (11) STD booth / Tele-Communication services; (12) Farms such as Agriculture Farm house, Plants Nurseries, Poultry farms, Fish/ Prawn Hatcheries etc. ; (13) Charitable or Other Trusts or Societies (registered under the Societies Registration Act, 1860); (14) Brick Kilns; (15) Slaughter houses; (16) All Security Agencies; (I7) Courier services; (18) Information Technology Enabled Services (ITES) and Information Technology (IT Establishments)

Registration, Renewal Made Online Under Punjab Shops And Establishment Act

As per Punjab Labour Department notification dated 27th October 2017, it has been ordered that henceforth all application for the registration, renewal or for any other purpose under the Punjab Shops and Commercial Establishments Act, 1958 shall be made through online system in electronic form. Inspector shall grant provisional registration certificate and renewal through online system within two working days from the date of submission of online application

Risk Based Exemption From Inspection Under Various Labour Laws

As per Notification published in the official Gazette of Goa dated 26th October 2017, the Government of Goa has notified risk based exemption from inspection under various labour laws as mentioned: 1. The Equal Remuneration Act, 1976, 2. The Minimum Wages Act, 1948, 3. The Maternity Benefit Act, 1961, 4. The Goa, Daman and Diu Labour Welfare Act,1986, 5. The Payment of Bonus Act, 1965, 6. The Payment of Wages Act, 1936, 7. The Inter State Migrant Workmen(Regulation of Employment and Condition of Service) Act, 1979, 8. The Motor Transport Workmen Act, 1961, 9. The Contract Labour (Regulation and Abolition) Act, 1970, 10. The Goa, Daman & Diu Shops and Establishments Act, 1973. Under this only the high risk establishments would be inspected by the concerned Labour Inspectors, the medium risk establishments have an option to choose between departmental inspection or third party Inspection. All low risk establishment are exempted from inspection and a third party certification in lieu of submission of self certification for compliance to all applicable labour laws. As per Punjab Labour Department notification dated 26th October 2017, the Annual returns can be filed online, there is no fee chargeable. It can be filed for the following viz. (1) Factories Act, 1948; (2) Punjab Shops and Commercial Establishment Act, 1958; (3) Maternity Benefit Act, 1961; (4) Employees Compensation Act, 1923; (5) Minimum Wages Act, 1948; (6) Payment of Wages Act, 1936; (7) Payment of Bonus Act 1965; (8) Principal Employer under the Contract Labour (Regulation & Abolition) Act, 1970; (9) Principal Employer under the Interstate State Migrant Workmen Act, 1979; and (10)The Motor Transport Act, 1961. Inspection Not Required Prior To Registration Under Rajasthan Shops And Establishment Act 1958

As per Rajasthan Labour Department circular dated 24th October 2017, the labour department under Business Reform Action Plan (BRAP-17) for Ease of doing business has stated that the establishments under the Rajasthan Shops and Commercial Establishment Act, 1958 who have made application to get registered under the act will be subjected for inspection under the mentioned Act only after registration is obtained

The Kerala Minimum Wages Notification (Aug 2017)

Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No. P3.Pdl.1/2017/DES, the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of August 2017 are as ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act
